Moyong demands establishment of

district court at Pasighat

ITANAGAR, Apr 23: Former Bogong Anchal chairperson Kaling Moyong in a letter to Parliamentary Secretary Law appealed for immediate establishment of District court at Pasighat to mitigate the difficulties faced by the people.

While highlighting the grievances of the people of East Siang District, Moyong said that people of the district and its neighboring districts are facing many problems in judicial matters as they had to go to Basar or Namsai or Tezu district court for trial or hearing of their cases. Even for any petty matters they had to go to the above mentioned courts which are unaffordable for most of people.

He further said “particularly in the monsoon season, it is more difficult for the people of East Siang district to attend the above mentioned courts as the road communication during the monsoon period becomes totally worst as Basar and Namsai areas becomes totally inaccessible resulting in non- attendance in the court at the stipulated time. Sometimes, even the summons or necessary documents do not reach in time due to the bad road conditions”, he added. Further, the practicing advocates of the district also finds it difficult to attend the court of law in time at Basar,Tezu or Namsai where the old and pending cases of  the  district are being tried, he said. Hence, the inability of their attendance in the court is hampering their reputation and they are unable to show their proficiency in their choicest field, Moyong added.

Sad but true

Tom Simai

The Central leadership’s soft stance on the issue of ‘Greater Nagalim’, the state government’s preferred silence on Naga People’s Front (NPF) political expansion and the muteness of Changlang and Tirap’s (C&T) MLA’s on being conferred the ‘Naga’ tag seems to have a common base – the Serial No. 10 of Schedule Tribe Notification (Constitution) 1950 Part XVII Arunachal Pradesh.

Considering the statement of Serial No. 10, the demand of ‘Greater Nagalim’, NPF’s political expansion and the ‘Naga’ tag for the natives of C&T sounds authentic. Because of the shocking verity that the major tribes – Tangsa, Nocte and Wancho’s of C&T are still officially known as ‘Naga Tribe’.

According to the scheduled tribe notification (Constitution) 1950 of Part XVII Arunachal Pradesh these major tribes of C&T are not included in the scheduled tribes list.  However, these tribes are being issued scheduled tribe certificates as Naga Tribe by the respective Deputy Commissioners as per the provision given in Schedule Tribe Notification (Constitution) 1950 Part XVII Arunachal Pradesh of Serial  No. 10 that categorized us as ‘Any Naga tribes’.

It is mandatory to use the word ‘Naga’ as suffix or under the bracket along with the name of our preferred tribe in the ST certificates. And due to non-inclusion, on many occasions ST certificate of these mentioned tribes appearing in Union Public Service Commission (UPSC) examination was rejected by the UPSC Board.

After this starling fact, the stands of our government on ‘Greater Nagalim’ sound so frivolous and unrealistic. Inclusively, we’re yelling that we’re not Naga but official status says we still are. So with given the facts, how justifiable are our heartfelt protest? Where do we go from here? In such embarrassing circumstance, how do we counter these claims?

Incredibly, the length and breadth of the state has been audacious enough to condemn and criticize the claims of Greater Nagalim, NPF expansion and Naga tag but none endeavored to analyze the reason of their claims upon C&T and its natives. As always, we’ve been placing our reservation with no historical evidences or genuine back up. In fact we’ve never tried to evaluate or comprehend Serial No 10, which seems to be the root cause of all these impudence and controversies?

Doesn’t this single point justify that our politicians are mere bunch of buffoons? These buffoons should be taken to task for not identifying and revising such significant constitutional error that has not only risked our territorial integrity but also jeopardized our independent ST status.

At this point of time, I’m wondering, why the MLA’s of C&T prefer to remain lull on every major social issue. They were mute when the Chakma-Hajong Refugees issue was at its peak, they were quiet when C&T was tagged as most corrupted districts, they were dumb when allegation were hurled for misappropriation of DoTC funds, they were silent when PRC controversy instigated riots. And now they’re averting to address this grim issue. Is their silence on the controversy a sign of ignorance or an act of cowardice? God only knows.

As a matter of fact, it’ll be a feeble fight against the claims. As Centre’s decision will be based on historical or constitutional evidences, it seems certain that someday NPF will soon realize their political ambitions within these precincts and the major tribes of C&T will always be categorized as ‘Any Naga Tribes’. And like always we’ll concentrate only on shouts and slogans without comprehending and mending the root cause – the Serial No 10. Sad but true. (The writer can be reached at simaitom@gmail.com)
